After last month’s rejection of the constitutional complaints against the Unified Patent Court (UPC), Germany has now published its legislation enabling ratification of the UPC Agreement.
In accordance with Article 89 of the UPC Agreement, once Germany deposits its instrument of ratification with the General Secretariat of the EU, the UPC Agreement will enter into force on the first day of the fourth month after the deposit.
The UPC Preparatory Committee now estimates the UPC will be operational mid-2022.
