Following the referral G2/21 to the EPO Enlarged Board of Appeal (EBA) on the use of post published evidence, the President of the EPO has announced with immediate effect that all examination and opposition proceedings in which the decision depends entirely on the outcome of the referral will be stayed ex officio. If proceedings are stayed, parties will be informed accordingly and any communication setting time limits will be withdrawn. No further such communications will be issued until the EBA gives its decision and the stay is lifted.
