On 28 May the EPO Enlarged Board of Appeal (EBA) assembled for the much anticipated hearing on legality of holding Oral Proceedings by videoconference when not consented to by parties. In the build up to the hearing, the Chairman and another member of the EBA were replaced to address potential issues of perceived partiality.
In the hearing the Opponent requested one month to respond to written submissions from the EPO President. Despite these being available on the EPO online public register for approximately a month, they were not forwarded to the parties until a few days before the hearing.
As a result, the Oral Proceedings will now continue on 2 July 2021.
